Terms Of Service

I retain the right to refuse any commission for any reason.

Not reading my TOS does not make you excused for breaking it.

These Terms of Service are relevant to non-commercial projects only.

Prices are subject to change based on demand.

If you want a custom oc, then a precise description is needed.

All drawings may or will include a subtle sign that you may not remove.

No deadlines.

No rushing, harassing, or rude behavior.

Credit me if you post your commission on any social media.

Feel free to ask for WIPs/updates.

If you don't have an idea for the pose/expression I will assume artistic liberty.

I require clear and high-quality reference images of a character (excluding custom ocs) or pets I am commissioned to draw. (Clear well-lit photos will result in the best likeness for pet portraits.)

The currency accepted is USD ($).

I accept Paypal

Most commissions must be paid 100% upfront.

If the commission is over $100 it can be paid 50% upfront and 50% after sketch approval.

Payment must be sent before I can start on your commission.

Do not send me any payment before I have agreed to give you a slot and requested you to send me the payment.

A PayPal invoice must be paid within 48 hours of it being sent. If it is not paid you will lose your slot. (Let me know if you need more time.)

I will notify you when I have started on your commission.

While I'm working on your commission I will make reviews with you to make sure I make it's just right for you!

During the reviews, I will send WIPs which will include a watermark and may be of lower quality than the finished piece.

You can ask for WIPs at any time!

If anything comes up that will slow the progress I will let you know ASAP.

Once the artwork is finished you will receive the full-resolution PNG image. Note: there is NO physical product! Digital files only.

The time it takes to finish your commission varies from 2 weeks-2 months depending on factors such as my health, the complexity of the commissioned piece, contact with the commissioner, and other work.

You can get 2 major changes in the sketch stage. After the sketch, there will be no big changes unless a misunderstanding from my side has been made.

I will accept small revisions for free if I see necessary.

A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made.

If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make.

If your reference is unclear to start with, changes will come at an extra charge.

I reserve the right to cancel and refund the order at any time for any reason.

I retain all copyrights over the commissioned artwork.

I will NOT claim the intellectual property (IP) of the commissioned artwork (your characters are still yours, etc.)

I will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms.

I reserve the right to post the commissioned artwork online on my social media to promot myself. (unless you would like me to keep it private)

You may upload the commissioned artwork on any website and social platforms as long as you give proper credit.

You may NOT make profits from the commissioned artwork (reselling, redistributing, uploading to POD services, making prints for selling, etc.)

You may NOT alter/edit the commissioned artwork without my (the artist's) consent.

You MAY be allowed to sell the artwork if it is a part of an Adoptable.

You retain the rights to the intellectual property (IP).

You may NOT use the commissioned artwork for commercial purposes.

Reproducing/using the copyrighted artwork commercially - that means making money off it in any way not excluded from these terms.

Claiming the artwork as your own.

Altering the artwork without my consent.

Removing my signature from the artwork.

The commissioner is not allowed a refund once I have started working on the commissioned artwork.

If for any reason I am unable to start your commission you will receive a full refund.

If you cancel your order before I start it, you can get a full refund.

If you are getting a refund, do not request a PayPal chargeback. I will transfer the money back to you myself.

If you request a PayPal chargeback at any point when you were not allowed to ask for a refund you will lose all the aforementioned rights to the commissioned artwork and I will have the full right to profit further from it in any way. I will decline the chargeback and supply PayPal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.

I must be credited as the designer/creator. (my Toyhouse is Toigr)

I may keep or resell any rejected design concepts if they are not claimed by the client.

You retain the rights to the character, however, I retain full rights to the original artwork that I have created. Be it a custom design or adopt.

You can upload my custom designs/adopts to any social media or gallery, and/or use it for personal reasons such as roleplaying, stories, etc.)

You can make minor changes to my custom designs/adopts (e.g., rename, regender, small marking changes, scars, etc as long as it's still recognizable.)

You can sell/trade/gift my custom designs/adopts (just let me know if you do)

You cannot use my custom designs/adopts for commercial/business use without my permission unless agreed upon.

You cannot sell my custom designs/adopts for more than you bought them for. (Unless you have commissioned/drawn more artwork for the custom design/adopt thus adding more value.)

You cannot remove my signature from my custom designs/adopts.

You can not use my art as NFTs.

You can not use my art for AI in ANY way.

You may not use AI to modify my art.

I will not accept AI references.
